WILLS

You need a Last Will and Testament to safeguard your assets and ensure that your wishes are carried out. Having your Texas Will prepared by an estate planning lawyer can be simple and affordable. And it will save your family a lot of headache, heartache, and money.

If you don’t have a valid will, Texas statutes determine who gets your estate.  The probate of your estate without a valid will is much more expensive and time-consuming.

If you need to change your will, you may not need to draft an entirely new will. You may only need a codicil.  Do not write on your will. Handwritten modifications on a typewritten will are usually ignored by the probate court.

TRUSTS

While it is important to have a Last Will and Testament, some of our estate planning clients also benefit from having a Texas testamentary or a living trust.  This is especially important if there are minor beneficiaries or beneficiaries with special needs.  I will consult with you to ensure your interests are best protected and only recommend what you need.  Depending on your situation, I may suggest a Texas trust tailored to your beneficiary’s needs.

PROBATE

When a loved one passes away, probate is the first step in the legal process for distributing your estate and paying your creditors.  If you are an executor of a Texas Will, you should retain a probate attorney.

ESTATE DISPUTES

If you are involved in an estate dispute, it is essential you consult with a probate attorney.  Estate disputes commonly involve contesting a Will, breach of fiduciary duty, contesting a Trust, guardianship of the estate, or protecting one’s rights as an heir under Texas Law.
